Privacy Policy

1. What this policy covers

This policy explains how we collect, use, and share personal information when you visit koniverwellness.com, purchase or use our educational products (including The Patient's Playbook and Koniver Method training), submit forms or applications, or receive our marketing emails and text messages.

What this policy does not cover: your medical records and clinical care. If you become a patient of the practice, health information created in that clinical relationship is protected health information handled separately under applicable law, including HIPAA — not under this website policy. Our patient portal and clinical systems are governed by those separate terms.

2. Information we collect

Information you give us:

• Contact details — name, email address, phone number — when you subscribe, download a resource, submit a form, or text/message us
• Responses you submit in our fit check, applications, and questionnaires
• Purchase information when you buy a course (order details and billing name; we do not store your full card number — payments are processed by our payment processors)
• Messages you send us (email, forms, support requests)

Information collected automatically: when you use the site, we and our service providers collect device and usage data via cookies, pixels, and similar technologies — IP address, device and browser type, pages viewed, referring links, and approximate location — including through Google Analytics, PostHog, the Meta (Facebook/Instagram) pixel, the TikTok pixel, and Klaviyo site tracking.

Information from service providers: e.g., confirmation of your purchase from our course platform (Kajabi) and its payment processors.

3. How we use information

• To deliver what you asked for: course access, resource downloads, responses to applications and inquiries
• To send marketing email and, where you've opted in, text messages (see Sections 6–7) — you can opt out at any time
• To understand how the site is used and improve it (analytics)
• To advertise our services, including building advertising audiences and showing ads to people who visited our site (retargeting) on platforms such as Google, Meta, and TikTok
• To detect fraud and abuse, enforce our terms, and comply with legal obligations

4. How we share information

We share personal information with:

• Service providers (processors) who run parts of our operations under contract: website hosting (Webflow), course delivery and checkout (Kajabi), email and SMS marketing (Klaviyo), payment processing (Kajabi Payments, processed via Stripe), analytics (Google Analytics and PostHog), business email and file tools (Google Workspace), scheduling and form tools (Jotform), and support tooling
• Advertising partners (Google, Meta, TikTok) via cookies/pixels for measurement and retargeting. Some state laws treat this as a "sale" or "sharing" of personal information for targeted advertising — you can opt out (Section 8)
• Professional advisers and authorities where required by law, to protect rights and safety, or in connection with a business transaction (merger, acquisition, financing)

We do not sell your personal information for money, and we do not share clinical/medical record information for advertising.

5. Cookies and tracking choices

We use necessary cookies (site function), analytics cookies, and advertising pixels. Your choices:

• Use the cookie notice on the site and the settings in your browser to limit or delete cookies
• Opt out of interest-based ads via the platforms: Google Ad Center, Meta Ad Preferences, and TikTok personalized ads settings, and industry tools such as the NAI and DAA opt-out pages
• Global Privacy Control: where required by law, we honor GPC browser signals as an opt-out of targeted advertising for that browser

Blocking some cookies may affect site features.

6. Email marketing

We send marketing email only to people who subscribed, downloaded a resource, made a purchase, or otherwise asked to hear from us. Every marketing email includes an unsubscribe link. Transactional emails (e.g., purchase receipts, course access) are sent regardless of marketing preferences.

7. Text messages (SMS)

If you opt in to text messages, we may send you updates and marketing texts via our messaging provider. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel at any time, or HELP for help. See our SMS terms page for full terms. We do not share your mobile opt-in with third parties for their own marketing.

8. Your privacy rights

Depending on your state of residence (including California, Colorado, Connecticut, Virginia, Texas, Oregon, and others with comprehensive privacy laws), you may have the right to:

• Know/access the personal information we hold about you
• Correct inaccurate information
• Delete personal information
• Portability — receive a copy in a usable format
• Opt out of targeted advertising and any "sale"/"sharing" of personal information
• Non-discrimination for exercising your rights

To exercise rights: email privacy@koniverwellness.com with your request and the email/phone you used with us. We will verify your identity (and permit authorized agents where the law provides). If we decline a request, you may appeal by replying to our decision; where applicable you may also contact your state Attorney General.

California notice: the categories of information we collect are described in Section 2; purposes in Section 3; and recipients in Section 4. We retain information as described in Section 10. We do not knowingly "sell" or "share" the personal information of consumers under 16.

9. Visitors outside the United States

Our services are designed for and directed to people in the United States, and information is processed on U.S. servers. If you visit from elsewhere (including the EU/UK), you understand your information is processed in the U.S. Where EU/UK law applies, our legal bases are consent, contract, and legitimate interests, and you may exercise rights of access, rectification, erasure, restriction, portability, and objection via privacy@koniverwellness.com.

10. Data retention

We keep personal information for as long as needed for the purposes above — for example, marketing profiles until you unsubscribe or after a period of inactivity, purchase records as required for tax and accounting, and application records for a reasonable period — then delete or de-identify it.

11. Security

We use commercially reasonable technical and organizational safeguards (encryption in transit, access controls, reputable vendors). No system is perfectly secure; please use unique passwords for any account.

12. Children

Our site and products are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13 (or as defined by applicable law). If you believe a child provided us information, contact privacy@koniverwellness.com and we will delete it.

13. Third-party links and embeds

The site links to and embeds third-party content (e.g., YouTube videos, podcast platforms, social networks). Those services have their own privacy practices, which we don't control.

14. Changes to this policy

We may update this policy from time to time; the effective date above will change and material changes will be highlighted on this page.
